Brazil Supreme Court schedules hearing on betting ban

Justice Luiz Fux of the Supreme Federal Court (STF) has scheduled a public hearing for November 3, 2026, at 10:00 a.m. to discuss the impacts of Provisional Measure 1,394/2026. This measure, signed by President Luiz Inácio Lula da Silva, prohibits the operation, offering, intermediation, and advertising of fixed-odds betting, commonly known as “bets,” in Brazil.

The hearing, held in response to legal challenges from the National Association of Games and Lotteries (ANJL) and the Brazilian Institute of Responsible Gaming (IBJR), aims to gather technical data and arguments from various sectors before a final ruling. The court has summoned 26 institutions, including the Attorney General’s Office (AGU), the Ministry of Finance, the Brazilian Football Confederation (CBF), and ten football clubs: Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo, Corinthians, Ponte Preta, Vitória, Guarani, and Portuguesa.

Economic studies indicate significant financial consequences for major football clubs due to the loss of sponsorship and advertising revenue. Flamengo faces a projected recurring revenue reduction of R$ 334.5 million, Corinthians a loss of R$ 198 million, and Palmeiras a reduction of R$ 163 million. Industry associations argue that the ban compromises legal certainty and may drive users toward illegal, unregulated platforms.
