Brazil Supreme Court suspends judicial indemnity payments

The Brazilian Supreme Federal Court (STF) has ordered the immediate suspension of indemnity payments to magistrates in seven state courts, including the Court of Justice of Paraná (TJPR). This decision follows scrutiny regarding high monthly earnings among judicial officials.

Data from the National Council of Justice (CNJ) indicates that 73 magistrates in Paraná received net monthly remuneration exceeding R$ 100,000 in April. This has sparked a legal debate regarding whether the constitutional spending ceiling should be applied to gross or net income.

A 2015 STF ruling established that the constitutional ceiling must be applied to gross remuneration to maintain parallelism between salary components, rather than using gross income to limit net income.
