TSE seeks consensus on AI use in Brazilian elections
The Brazilian Superior Electoral Court (TSE) is preparing to address the use of artificial intelligence in political campaigns. TSE President Kassio Nunes Marques has called for a meeting with fellow ministers to seek consensus on how to judge cases involving AI-generated content. This follows a legal challenge by the PT party regarding a deepfake video used during a Liberal Party (PL) convention. The video featured a digital avatar of Jair Bolsonaro supporting the presidential candidacy of his son, Senator Flávio Bolsonaro.
The court is considering whether to expand existing restrictions to include a definitive ban on deepfakes during the electoral period. While current rules prohibit AI use intended to deceive, some ministers are advocating for broader prohibitions on any synthetic manipulation of images, video, or voice. The defense for Flávio Bolsonaro's campaign argues the video is legal because it was explicitly labeled as AI-generated, preventing public confusion.
In related efforts to ensure electoral integrity, the TSE has established the Advisory Council on Informational Integrity to monitor disinformation and AI misuse. Additionally, President Nunes Marques has defended the reliability of Brazil's electronic voting system, highlighting public demonstrations and simulated voting sessions designed to increase transparency.
