Brazil Supreme Court debates ban on online betting

The Brazilian Supreme Federal Court (STF) held a public hearing to debate the validity of Provisional Measure 1.394/2026, which prohibits the operation, supply, and advertising of fixed-odds online betting. Justice Luiz Fux, the rapporteur for the case, expressed his perception that online betting should be banned, characterizing ludopathy as a public health problem.

Government representatives, including Health Minister Alexandre Padilha and Attorney General Jorge Messias, defended the ban. Padilha cited a 200% increase in SUS (Unified Health System) consultations related to betting harms, while Messias argued the state must intervene when economic activities compromise fundamental rights.

Conversely, representatives from major football clubs, including Flamengo, Fluminense, Botafogo, and Corinthians, criticized the measure. They argued the ban threatens financial stability and legal certainty for existing sponsorship contracts. Flamengo estimated a potential annual revenue loss of R$ 430 million and warned of impacts on approximately 1,200 employees. Fluminense projected a loss of R$ 200 million in one year. Clubs also criticized the ten-day transition period established by the government.
