Brazil Supreme Court upholds detention of Vorcaro's father and cousin

On 16 April, Brazil's Supreme Court (STF) confirmed the preventive imprisonment of Henrique Vorcaro and his nephew Felipe Vorcaro, the father and cousin of banker Daniel Vorcaro. The decision was taken by the Court's Second Panel with a 3‑1 vote; ministers Luiz Fux, Kassio Nunes Marques and relator André Mendonça voted to maintain the custody, while Gilmar Mendes advocated replacing it with house arrest. Minister Dias Toffoli abstained, citing a conflict of interest.

The two men are accused, in the Federal Police's Operation Compliance Zero, of helping conceal funds obtained through fraud schemes at Banco Master and of involvement in an attempted purchase of the institution by the public Bank Regional of Brasília (BRB). Their defence argues the detention is "extreme, unnecessary and disproportionate" and complains of limited access to the investigative documents, claiming this hampers a full exercise of the right to defence. The ruling underscores the court's assessment that the legal criteria for preventive detention – risk of obstruction of justice and seriousness of the alleged crimes – remain satisfied.

The case highlights ongoing tensions in Brazil between aggressive anti‑corruption investigations and procedural safeguards for high‑profile defendants, with potential repercussions for the broader financial sector and corporate governance.
