Brazil survey shows divided opinion on condominium control of Airbnb

A survey conducted by Loft in partnership with Offerwise reveals a divided Brazilian public regarding the authority of residential condominiums to regulate or veto short-term rentals, such as those via Airbnb. According to the data, 39% of respondents agree that condominiums should have the power to authorize or veto these rentals, while 32% believe the decision should rest solely with the property owner. Another 29% remained undecided.

The study, which interviewed 1,400 people across six Brazilian capitals in July 2026, highlights practical tensions within residential buildings. Approximately 16% of respondents reported experiencing issues such as noise, insecurity, or high turnover due to short-term guests. Conversely, 11% of those surveyed have already rented or attempted to rent their own units through such platforms.

This debate coincides with legal developments in the Superior Tribunal de Justiça (STJ). The court has previously ruled that short-term rentals in residential condominiums require approval from two-thirds of the residents, treating recurring rentals as a change in the property's intended use. The STJ has suspended local decisions on the matter to establish a uniform national rule.
