Brazil TSE manages surge in electoral judicialization and disinformation

The Superior Electoral Court (TSE) of Brazil is addressing a significant increase in judicial processes, which have risen by more than 200% compared to the 2022 presidential election. TSE President Kassio Nunes Marques met with representatives from the Luiz Inácio Lula da Silva and Flávio Bolsonaro campaigns to discuss strategies to reduce excessive litigation and ensure a balanced contest.

Key disputes involve digital platforms and disinformation. The ‘Exército do Lula’ WhatsApp channel, which has over 4 million followers, was briefly suspended by Nunes Marques due to a lack of formal registration but was authorized to resume operations after the Lula campaign registered the channel with the TSE.

Additionally, the TSE has issued several orders to remove content deemed misleading. This includes a video featuring children criticizing Lula, which Minister Marco Aurélio Bellizze ruled exploited the innocence of minors, and a video falsely associating a pro-Lula rally in São Paulo with drug use. The court also addressed concerns regarding Meta’s AI tools, which reportedly showed inconsistencies in generating images for the two candidates.
