Contran updates Brazil's Lei Seca enforcement rules

The National Traffic Council (Contran) has implemented new regulations for 'Lei Seca' (Drunk Driving Law) enforcement across Brazil. Resolution No. 1.031/2026 updates procedures that have been in place since 2013, introducing a preliminary screening phase known as a 'pre-test' or passive alcohol test.

This screening process is indicative and cannot be used as the sole basis for a fine or legal charge. If a pre-test indicates the presence of alcohol or other substances, drivers must undergo confirmatory testing via a traditional breathalyzer (etilômetro) or through the observation of at least two physical signs of impaired psychomotor capacity. The new rules also allow for the use of certified equipment, such as 'drogômetros', to detect various psychoactive substances through oral fluid analysis.

While the regulation is now in effect, the full implementation of updated inspection forms and infraction codes will take 60 days. The Federal Highway Police (PRF) noted that while these rules provide the legal framework for future technology integration, current highway enforcement procedures remain largely unchanged. Refusal to undergo testing continues to carry severe penalties, including heavy fines and license suspension.
