Brazilian bill to let retirees recalc pensions using pre‑1994 contributions
Deputy Ribamar Silva (Pode‑SP) introduced Bill PL 3379/2026 to allow beneficiaries of the Instituto Nacional do Seguro Social (INSS) to choose the most advantageous pension calculation method, including contributions made before July 1994. The proposal revives the “full‑life” (revisão da vida toda) rule, which the Supreme Court recognized in 2022 but limited in March 2024.
The bill would apply automatically to benefits granted between November 1999 and November 2019, with the higher amount taking effect from the law’s entry into force and no retroactive payments. It also permits retirees currently engaged in court cases over their calculations to withdraw those actions in favor of an administrative review. The measure seeks to correct perceived inequities from the 1999 transition rule that excluded pre‑1994 earnings. Legislative approval by both the Chamber of Deputies and the Senate is required before it becomes law.
