Brazilian court orders telecom operator to pay damages for fraudulent contracts
The Court of Justice of the Federal District and Territories (TJDFT) has ordered a telecommunications operator to pay R$ 4,000 in moral damages to a consumer who was incarcerated between 2015 and 2024.
During his imprisonment, several telephony and internet contracts were registered in his name without his consent. These fraudulent charges, dating from 2021 and 2024, were subsequently listed on the Serasa credit platform. The court ruled that being incarcerated does not strip an individual of their legal rights to dignity and the protection of personal data and assets. The decision emphasized that the operator failed to prove the consumer had personally contracted the services while in a closed prison regime.
