Brazilian courts block local legislative actions in Pará de Minas and São Miguel do Gostoso

In Pará de Minas, a judge denied a preliminary injunction requested by the municipal government to force the City Council to hold an extraordinary meeting for voting on a Tax Code reform. The proposed legislation contains over 300 articles and aims to modernize municipal tax rules. The court ruled that the technical complexity of the matter requires careful evaluation, making it incompatible with the exceptional urgency required for an injunction. The decision also noted the importance of legislative autonomy regarding internal organizational matters.

In São Miguel do Gostoso, a judge suspended the early election of the City Council's Board of Directors for the 2027/2028 biennium. The ruling, issued in response to a writ of mandamus, determined that municipal law and internal regulations require such elections to occur during the final ordinary session of the legislative period, rather than in an extraordinary session. The acting president is prohibited from conducting the election before the scheduled final session in December 2026, with a fine of R$ 30,000 set for any non-compliance.
