Brazilian Courts Boost Uniformity and Clarify Procedural Acts
Legal expert Valdemir Ferreira Santos explained the distinct roles of a despacho, an interlocutory decision and a sentence in Brazilian civil procedure. A despacho moves a case forward without deciding merit and cannot be appealed; an interlocutory decision resolves a specific issue and is subject to agravo; a sentence ends the first‑instance phase and may be appealed to a higher court. Understanding these differences helps parties avoid missed deadlines.
The Tribunal de Justiça of Mato Grosso has created the Núcleo de Gerenciamento de Precedentes e de Ações Coletivas (NUGEPNAC) to manage qualified precedents, repetitive cases and collective actions. The unit monitors Supreme Court and Superior Court rulings, communicates settled theses to judges, and tracks suspended processes, aiming to speed up proceedings, ensure consistent decisions and strengthen legal certainty across the state’s judiciary.
