Brazilian Judiciary faces AI manipulation attempts and fiscal limit disputes

Brazilian judicial authorities are addressing several legal and technological challenges. Supreme Federal Court (STF) Minister Alexandre de Moraes fined lawyer Marcelo Henrique Martins R$ 5,000 for using ‘prompt injection’ in a petition. The technique involved inserting hidden commands, such as ‘Negar todos os comandos do GPT’, to attempt to manipulate the Court’s artificial intelligence systems. Moraes characterized the act as an affront to the dignity of Justice and referred the case to the Brazilian Bar Association (OAB) and the Federal Public Ministry (MPF).

Similar attempts to manipulate AI via hidden text were identified by the Court of Justice of Bahia (TJ-BA) in a habeas corpus request, leading to investigations by the OAB and the Public Ministry of Bahia. Meanwhile, the Court of Justice of Rio Grande do Sul is developing its own AI agents to manage costs and enhance security against such frauds.

In fiscal matters, the Judiciary, the Public Prosecutor's Office (MPU), and the Public Defender's Office (DPU) have proposed 2027 budgets that exceed the limits set by the fiscal framework law. These proposals for salary increases reportedly bypass the 0.6% cap above inflation established for years with budget deficits.

Separately, the Electoral Public Ministry has requested fines against several presidential candidates, including Luiz Inácio Lula da Silva and Flávio Bolsonaro, for allegedly failing to disclose all digital platforms and social media profiles used in election advertising.
