Brazilian courts issue major rulings on insurance and real estate taxation
The Brazilian judiciary is issuing several key rulings regarding taxation that impact the financial and real estate sectors.
In a 5-4 decision, the Supreme Federal Court (STF) ruled that PIS/Cofins taxes do not apply to the financial returns of technical reserves held by insurance companies and private pension entities. Separately, the Superior Court of Justice (STJ) upheld the collection of a 20% Income Tax on capital gains realized by real estate funds when they sell shares of other funds.
