Brazilian courts issue separate rulings on discrimination and real estate fraud
In Londrina, Paraná, the Court of Justice of Paraná (TJPR) upheld a ruling ordering a condominium and its sub-manager to pay R$ 10,000 in moral damages to a resident. The decision follows an incident in a WhatsApp group where the sub-manager used a pejorative expression related to indigenous ethnicity to criticize a resident. The court determined that using discriminatory language in a collective living space violates fundamental rights to honor and dignity, exceeding the limits of freedom of expression.
In Acre, the Court of Justice of Acre ordered a resident of Brasileia to pay R$ 120,000 in damages after a real estate dispute involving cattle. The woman had entered a verbal agreement to sell a property in exchange for a herd of cattle. After receiving and selling part of the livestock, she refused to transfer the property and instead sold it to a third party. The court ruled that her actions violated the principle of good faith, as she had previously signed a public deed acknowledging receipt of the cattle without reservation.
