Brazilian courts rule against Receita Federal over tax debt compensation

Federal Regional Courts (TRFs 1 through 6) in Brazil are ruling against the Receita Federal do Brasil (RFB) for illegally blocking the compensation of tax debts using judicial credits obtained from third parties.

The courts determined that the tax authority has been ignoring Constitutional Amendment No. 113/2021 and relying on outdated regulations to prevent the 'encontro de contas' (settlement of accounts). This practice violates Article 100 (§11) of the Federal Constitution, which permits companies to use liquid and certain credits—whether their own or acquired from others—to settle tax debts or installments.

The judiciary has ordered the Union to establish administrative mechanisms to facilitate these operations, ensuring legal certainty for companies and specialized tax consultancy firms. The RFB had previously cited the lack of specific fields in administrative systems, such as the e-CAC portal, to deny these requests.
