Brazilian courts rule on compensation for road accident victims
Two separate judicial decisions in Brazil have addressed compensation for victims and heirs of traffic accidents.
A court in Santa Catarina ordered a trucking company and a driver to provide a lifelong monthly pension and R$ 40,000 in damages to a truck driver permanently disabled in a 2023 collision on the BR-116 highway in Bahia. The ruling follows a Federal Highway Police report confirming the defendant's vehicle crossed into the opposite lane, causing the accident. The victim suffered severe neurological damage and lost approximately 80% of his working capacity.
In a separate case in Salvador, Bahia, a settlement was approved for R$ 19,276.56 to be paid to the heirs of a man who died following a 2013 accident. The settlement was reached during a DPVAT insurance judicial marathon aimed at accelerating legal proceedings. The case involved a permanent disability caused by an ankle fracture sustained during the accident.
