Brazilian farmer secures 10‑year debt restructuring from Caixa
A federal court in Cáceres, Mato Grosso, ruled that Caixa Econômica Federal must restructure a rural credit debt of R$ 925.6 k for a soybean producer. Judge Ana Lya Ferraz da Gama Ferreira granted a ten‑year repayment schedule, with the first installment due in March 2027, suspended the ongoing extrajudicial execution and barred any interest or penalty charges. The decision was based on technical evidence showing a loss of more than 50% in soybean productivity due to climate factors, rendering the original contract unsustainable.
The ruling coincided with the entry into force of CMN Resolution 5.314, which amended the Manual of Rural Credit to give banks greater discretion over debt extensions. While the judgment does not automatically apply nationwide, it is seen as a leading precedent that could increase the judicialization of rural credit. Legal analysts warn that banks may need to tighten risk assessments, demand stronger guarantees, and possibly raise interest rates if similar cases spread. Caixa plans to appeal, and the matter may reach the Superior Court of Justice for final resolution.
