Brazilian journalist Luan Araújo sentenced to open‑regime prison for unpaid defamation fine

Judge José Fernando Steinberg of the Barra Funda Criminal Court in São Paulo ordered that journalist Luan Araújo serve his sentence in an open‑regime prison after he failed to pay an indemnity of roughly R$ 2,200 for a defamation conviction against former federal deputy Carla Zambelli. Araújo was found guilty of defamation for a November 2022 post that described Zambelli as part of an “extreme‑right sect” and a “mercador da morte”. The court invoked article 44, paragraph 4 of the Penal Code, converting his earlier community‑service term into custodial detention. Araújo, who was previously pursued by Zambelli with a firearm in October 2022, posted on social media that the sanction is “injusta” and asserted his economic hardship, while his lawyers argue the measure amounts to a prison for debt. Zambelli herself was later condemned by the Supreme Federal Court to five years and three months for illegal weapon possession and illegal constraint and remains in Italy fighting extradition.
