São Paulo Court prohibits Meta from using journalistic content for AI training

A São Paulo court has issued an injunction prohibiting Meta from collecting and using journalistic content from media outlets without authorization. The decision, handed down by Judge Guilherme Madeira Dezem of the 44th Civil Court, specifically prevents the company from using such content to develop, research, or train its artificial intelligence systems, including Meta AI.

The ruling follows a lawsuit filed by a coalition of three major Brazilian media associations: the National Association of Newspapers (ANJ), the Brazilian Association of Radio and Television Broadcasters (ABERT), and the National Association of Magazine Publishers (ANER). The associations argued that Meta’s new commercial terms, scheduled to take effect on November 20, constituted an abuse of economic power by conditioning continued access to platforms like Facebook, Instagram, and WhatsApp on the free, unrestricted licensing of intellectual property.

The injunction requires Meta to keep the accounts and digital tools of the associated media outlets fully functional without restrictions or retaliatory measures. To ensure compliance, the court set a daily fine of R$ 1 million, capped at R$ 100 million. The judge noted that the high fine was justified by Meta’s perceived reluctance to comply with previous judicial decisions in other cases.
