Brazilian Labor Courts Rule on ESPN Hiring Fraud Claim and Autistic Employee Telework

The 65th Labor Court of São Paulo dismissed a public civil action brought by the Ministry of Labor that alleged fraudulent "pejotização" of ESPN Brazil commentators, presenters and analysts. The court found no legal subordination, affirmed the autonomy of the contracts and rejected the request for collective moral damages. The decision remains subject to appeal.

In a separate case, the Regional Labor Court of São Paulo upheld a ruling that granted a web developer at the São Paulo Pharmacy Council, diagnosed with autism, full telework and a 30% reduction in working hours without loss of salary. The court also ordered the employer to pay R$ 10,000 for moral damages, citing constitutional rights, the International Convention on the Rights of Persons with Disabilities and Brazil's inclusion law.
