Brazilian labor laws regarding vacation payments and election poll worker rights
Under Brazilian labor legislation, specifically Article 145 of the CLT, companies are required to pay employees for their vacation at least two days before the rest period begins. This payment must include the standard remuneration plus the constitutional one-third bonus. If vacation is split into multiple periods, each segment must be paid at least two days before its respective start date. While late payments constitute administrative infractions subject to fines, a 2022 Supreme Federal Court (STF) decision in ADPF 501 removed the automatic requirement for double payment that was previously established by TST Precedent 450.
Additionally, citizens serving as poll workers (mesários) during elections are entitled to specific labor compensations. For every day of service, including training sessions provided by the Electoral Court, workers are granted two days of paid leave. Employers are prohibited from deducting these days from the employee's salary. To claim these rights, workers must present official documentation issued by the Superior Electoral Court (TSE) or the corresponding electoral registry office.
