Brazilian municipalities must report on beach management
Municipalities in Brazil that have assumed management of federal beaches and waterfronts are required to submit a detailed report to the federal government by December 12. The report must include data regarding environmental conditions, usage, infrastructure, and management methods.
Additionally, the documentation must cover common-use areas involving economic exploitation, such as boardwalks, squares, and public parks, alongside a summary of actions taken by the municipality throughout the year. Under the Beach Management Adhesion Term, these 80 municipalities—out of 279 coastal municipalities in Brazil—are entitled to retain revenue generated from the use of these areas. In exchange, they commit to oversight and the development of integrated management plans for these spaces.
The agreement specifically covers the sand, boardwalks, and areas used by bathers, but excludes ‘marine areas’ (áreas de marinha), which extend from the high-tide mark to 33 meters inland. These marine areas remain a subject of political debate regarding a constitutional amendment proposal known as the ‘Beach PEC’, which seeks to transfer portions of these federal lands to states, municipalities, or private entities.
