TSE reverses suspension of 'Exército do Lula' WhatsApp channel

The Brazilian Superior Electoral Court (TSE) has been embroiled in a legal dispute regarding the 'Exército do Lula' WhatsApp channel, a digital mobilization tool with over 3 million members created by Federal Deputy André Janones.

Initially, TSE President Kassio Nunes Marques ordered the channel's suspension following a request from Flávio Bolsonaro's campaign, which alleged the platform was used to spread disinformation regarding social programs like Bolsa Família. However, Electoral Corregedor Ricardo Villas Bôas Cueva later overturned this suspension, ruling that the total deactivation of the channel was disproportionate and lacked sufficient evidence to justify a complete block. Cueva noted that specific instances of false content do not necessarily mandate the closure of an entire communication space.

Flávio Bolsonaro's campaign has also sought the revocation of the Lula-Alckmin ticket registration and requested that the TSE clarify the legal basis for its actions. Meanwhile, Luiz Inácio Lula da Silva has criticized the initial suspension as an 'undue intrusion' by the judiciary. The case has been referred to the TSE plenary for a final decision.
