Brazilian Senate approves mandatory rural insurance subsidies
The Brazilian Senate has approved PL 2.951/2024, a bill aimed at modernizing the legal framework for rural insurance. The legislation transforms economic subsidies for insurance premiums into a mandatory expense under the responsibility of the Ministry of Agriculture.
Senator Jaime Bagattoli, the rapporteur, defended the bill against concerns regarding the Fiscal Responsibility Law, stating that the project includes necessary compensation mechanisms, such as fines, increased revenue from the Special Regime for Asset Regularization (REARP), and reduced federal tax benefits on private insurance. The subsidy is not a new expense, as it has appeared in annual budget projects since 2005, with projected growth from R$ 1.018 billion in 2026 to R$ 2 billion by 2028, contingent on fiscal goals.
Key features of the bill include the creation of a 'Catastrophe Fund' to provide supplementary coverage for climate-related risks and the granting of priority access to rural credit for producers with insurance policies. The bill also establishes specific timelines for indemnity payments, ranging from 15 to 30 days depending on the necessity of technical inspections. The measure seeks to increase the current insurance coverage, which presently protects only about 5% of Brazil's planted area, thereby enhancing agricultural income stability and national food security.
