Brazilian Senate approves end of 6x1 work schedule

The Brazilian Senate has approved a constitutional amendment (PEC 221/2019) to end the 6x1 work schedule, which requires employees to work six days for every one day of rest. The reform, passed in two rounds of voting with 75 votes in favor and only one against, will reduce the maximum weekly work hours from 44 to 40 without reducing salaries.

The implementation will follow a gradual transition period. Within 60 days of promulgation, companies must adopt a 5x2 schedule and limit the workweek to 42 hours. After 12 to 14 months, the limit will drop to 40 hours. The amendment guarantees two paid rest days per week, with one preferably falling on a Sunday.

Senator Hamilton Mourão was the sole dissenting vote. Notably, Senator Flávio Bolsonaro, who initially expressed caution, changed his position to vote in favor of the reform. The measure is a key political priority for President Luiz Inácio Lula da Silva during the current electoral cycle. Certain groups, including public servants, micro-entrepreneurs (MEIs), and high-earning professionals with salaries above R$ 21,188.87, are subject to different rules or are excluded from the standard reduction.
