Brazilian Senate to vote on 40-hour workweek reform

The Brazilian Senate has scheduled a first-round vote for Wednesday, October 14, regarding Constitutional Amendment Proposal (PEC) 221/2019. The measure aims to end the 6x1 work schedule by reducing the maximum weekly work hours from 44 to 40 without reducing employee salaries.

The proposal includes a 14-month transition period. Within 60 days of promulgation, the weekly limit will decrease to 42 hours, followed by a reduction to 40 hours after 12 additional months. The amendment also guarantees two paid days of rest per week. For workers with higher education degrees earning above R$ 21,188.87, the duration of work may be negotiated directly with employers, provided a 5x2 schedule is maintained.

Senate President Davi Alcolumbre stated the scheduling follows regimental rules. While the government is seeking to accelerate the process through special calendar requests, opposition members have expressed interest in postponing the debate until after the election period. To pass, the amendment requires approval by at least three-fifths of the Senate in two separate voting rounds.
