Brazilian Supreme Court denies habeas corpus for gang leaders Marcola and Beira-Mar

The Brazilian Supreme Federal Court (STF) has denied a preventive habeas corpus petition filed on behalf of criminal leaders Marcola (Marcos Willians Herbas Camacho) and Fernandinho Beira-Mar (Luiz Fernando da Costa). The petition, submitted by Pastor Oséas de Campos, requested that the two individuals be moved to a secure location known only to the judiciary, the Public Prosecutor's Office, and their families.

The request was based on the claim that the leaders of the Primeiro Comando da Capital (PCC) and Comando Vermelho (CV) faced a risk of kidnapping by the United States CIA. The petitioner warned that such an event could trigger a ‘salve geral’—a coordinated wave of violent criminal attacks across multiple Brazilian states, similar to the 2006 violence in São Paulo.

The legal action follows the United States government's decision to classify the PCC and CV as foreign terrorist organizations, a designation that took effect in June 2026. However, Justice Edson Fachin denied the petition, stating that the request did not present a concrete act for the Supreme Court to analyze.
