Brazil: Paternity rights and registration trends expand
As Brazil celebrates Father's Day, significant legal and social developments regarding paternity and parental rights are emerging.
Data from Arpen-Brasil reveals that between July 2016 and July 2026, approximately 1.67 million children were registered in Brazil without the father's name. Despite this, there is a growing trend in voluntary paternity recognition, which is expected to hit record highs in 2026. However, a study indicates that 36.2% of these recognitions occur after the child has already reached six years of age.
On the legislative front, a new federal law sanctioned by President Luiz Inácio Lula da Silva will gradually expand paternity leave from 5 days to 20 days. This transition will move to 10 days in 2027 and reach the full 20-day mark by 2029. Additionally, the state of São Paulo has already implemented a law extending leave for state employees to 20 days, including protections for adoptive parents.
Health authorities are also promoting paternal engagement through specialized services like 'Man's Prenatal Care' to encourage active involvement in child-rearing from the earliest stages of pregnancy.
