Brazil AGU seeks to declare online betting laws unconstitutional

The Brazilian Attorney General's Office (AGU) has requested that the Supreme Federal Court (STF) declare the laws regulating fixed-odds betting (bets) unconstitutional. This marks a significant shift in position for the AGU, which previously supported the legality of the framework. The AGU argues that the current regulations fail to protect fundamental rights, citing risks such as increased family indebtedness, lack of protection for minors, and a 140% rise in SUS medical consultations related to gambling disorders between 2018 and 2025.

Simultaneously, the federal government has implemented a provisional measure (MP) to prohibit the operation and advertising of online betting platforms. Starting October 6, the Ministry of Justice will redirect traffic from betting sites to the official 'Brasil sem Bets' government portal. The government has also ordered the blocking of related domains, IPs, and APIs.

In response, the sports sector is challenging these measures. Flamengo has filed for an injunction to suspend the provisional measure, citing potential financial losses of up to R$ 430 million for the club and R$ 2.5 billion for Brazilian football. The club argues that the ban threatens valid sponsorship contracts, such as its master agreement with Betano. The STF, with Minister Luiz Fux as rapporteur, is currently reviewing these legal challenges.
