Brazil's ANP to Access Fuel Invoices to Fight Fraud

The National Agency of Petroleum, Natural Gas and Biofuels (ANP) will be granted permanent access to electronic invoices, consumer invoices and electronic transport documents of companies and agents under its regulation. The measure is contained in Complementary Bill PLP 109/2025, authored by Deputy Alceu Moreira (MDB‑RS) and approved on 8 July by the Senate’s Commission of Supervision and Control (CTFC) with a favorable opinion from Senator Dr. Hiran (PP‑RR). It now proceeds to the Constitution and Justice Committee.

Access to these data will become a condition for granting or renewing licenses, including for firms that already hold authorizations. The agency will use the information to cross‑check production, commercialization and tax figures, helping to identify fuel adulteration, tax evasion and other illicit practices. The data will remain under fiscal secrecy and the implementation costs will be borne by the ANP. As the relator noted, the proposal will “enhance the state’s supervisory and regulatory role while defending consumer protection and free competition.”
