Brazil's ANTT fines firms R$932 million for freight floor breaches

A provisional measure (MP 1.343/2026) was approved by Brazil's Chamber and Senate and converted into Law 6/2026, updating the rules for road cargo transport. The new legislation expands the criteria the National Land Transport Agency (ANTT) must use to set minimum freight rates, incorporating total operational costs such as distance, vehicle type, cargo nature, fuel prices, maintenance, salaries and other variables. ANTT is required to publish a detailed calculation sheet twice a year and may adjust rates when fuel prices change by 5% or more.

In the first months of 2026, ANTT reported issuing 270,400 infringement notices and collecting R$932.4 million in financial penalties for companies that paid freight below the mandated minimum. The penalties reflect ongoing resistance to the policy, which was originally introduced in 2018 after a nationwide truckers' strike to protect carrier earnings and ensure the financial sustainability of the sector.
