Brazil's Arbitration Law marks 30 years with SME expansion
Brazil's Arbitration Law (Law No. 9.307/1996) has reached its 30-year milestone, coinciding with the Mediator's Day in the state of São Paulo. The anniversary highlights a growing trend of democratization within the institute, as mediation and arbitration expand beyond large-scale contracts to include small and medium-sized enterprises (SMEs).
According to the Business Mediation and Arbitration Chamber of the Commercial Association of São Paulo (CEMAAC/ACSP), these methods are becoming increasingly popular among SMEs, which have historically been disadvantaged by the slow pace of the traditional judiciary. Experts note that the speed of arbitration provides essential predictability and business continuity for smaller entrepreneurs who may not survive lengthy legal proceedings.
