Brazil's INSS explains temporary disability benefit rules and denial factors

The INSS (Instituto Nacional do Seguro Social) does not set a legal maximum for the temporary disability benefit, now called "auxílio por incapacidade temporária". The duration is determined by the medical examiner’s estimate of recovery. If the examiner does not specify an end date, the system automatically terminates the payment after 120 days. Beneficiaries must request an extension in the last 15 days of the approved period, which can be done through the Meu INSS app or website.

Common reasons for denial of the benefit include: (1) assuming a diagnosis alone proves incapacity; (2) failing to provide detailed medical documentation that links the condition to an inability to work; (3) submitting generic or incomplete medical reports; (4) not demonstrating a clear nexus between the illness and the claimant’s occupation; and (5) inconsistencies between the claimant’s statements and submitted records. Proper documentation and timely extension requests are essential to maintain the benefit.
