Brazil's INSS rolls out early retirement rules for disabled workers and real‑time employer benefit system
A new provision under Brazil’s National Institute of Social Security (INSS) allows people with disabilities aged 44 to 60 to retire early and receive a maximum monthly benefit of R$ 8,475.55, based on Complementary Law No. 142 and Interministerial Ordinance MPS/MF No. 13. The rule removes the standard minimum‑age requirement and calculates the pension on 100 % of the contribution average, provided the worker passes a medical and social assessment.
At the same time, INSS has launched the "INSS Empresa" platform, giving companies remote, real‑time access to details of employees’ benefit claims—such as type, start and end dates, and current status. The tool is intended to eliminate the "limbo previdenciário" where a benefit ends without the employer’s knowledge, reducing legal exposure and enabling prompt actions like return‑to‑work examinations, reintegration planning, or contesting the benefit termination.
