Brazil's Judiciary faces challenges with digital evidence and AI

The Brazilian judicial system is navigating new complexities regarding the validity of digital evidence and the integration of artificial intelligence. A recent decision by the Sixth Panel of the Superior Tribunal de Justiça (STJ) highlighted these issues when it replaced a preventive detention with precautionary measures pending a forensic analysis of chat screenshots used in a criminal case. The court emphasized that the reliability of such material depends on technical verification by third parties rather than the authority of the person accessing the content.

To address the rise of AI in legal settings, the National Council of Justice (CNJ) issued Resolution No. 615/2025 on March 11, 2025. This resolution establishes governance guidelines for the development and use of AI tools within the judiciary, mandating human supervision. Experts note that legal professionals must now bridge the gap between law and technology to ensure the authenticity, integrity, and lawful collection of digital files, as even unaltered files may present incomplete contexts.
