Flávio Dino orders Congress to draft accountability matrix for parliamentary amendments
Supreme Court minister Flávio Dino ordered the Chamber of Deputies and the Senate to submit to the Court a detailed matrix of responsibilities for the execution of parliamentary amendments. The order follows reports from the Controladoria‑Geral da União, the Tribunal de Contas da União and the Federal Police that identified recurring irregularities in the handling of emendas. Dino set a ten‑day deadline for the legislative houses, the Presidency and the AGU and PGR to provide the matrix, later extended to 19 August because of the Court’s recess.
The decision builds on the Supreme Court’s December 2022 ruling that the RP8 and RP9 amendments were unconstitutional and on a subsequent congressional resolution that changed the rules for distributing resources by rapporteur amendments. The action was filed by the Rede Sustentabilidade party, which seeks to make parliamentarians who indicate impositive amendments subject to the same accountability standards as fiscal “ordenação de despesas”.
A Tribunal de Contas audit of Pix‑type emendas, prompted by Dino’s order, found irregularities in 82 % of the sampled transfers, estimating a loss of roughly R$ 49 million. These findings will be sent to Dino to inform the ongoing ADI 7995, which seeks a formal framework for identifying the agents responsible at each stage of the expenditure cycle.
