Brazil's NR-1 Mental Health Rule Remains as Fine Suspension Begins

Brazil's updated labor regulation NR‑1, which obliges companies to identify and manage psychosocial risks such as moral harassment, stress and excessive workload, continues to apply despite a Supreme Federal Court (STF) decision that suspended the associated fines for 90 days. The suspension, ordered by STF minister André Mendonça, aims to give employers time to clarify the rule’s requirements and develop clearer criteria for compliance, but does not alter the duty to protect workers' mental health.

At the same time, Brazil is experiencing a sharp rise in work‑related burnout, with reported cases increasing 823 % over four years and mental‑health disorders becoming a leading cause of sick leave. Psychiatrist Rafael Latorraca, speaking to Folha Espírita, highlighted the need for professional treatment while noting that spiritual practices such as prayer and the “Evangelho no Lar” may complement conventional care. The convergence of regulatory enforcement and growing health concerns underscores the pressure on Brazilian employers to address workplace mental‑health risks.
