STF President Edson Fachin plans to archive Fake News inquiry

Supreme Federal Court (STF) President Edson Fachin has announced his intention to permanently archive the Fake News inquiry, an investigation opened in 2018 to combat disinformation and attacks against the judiciary. Fachin communicated this intent via an official letter to Minister Luiz Fux.

This move follows a request from Minister Fux, who had previously ordered the court's judicial secretariat to grant his office full electronic access to confidential files within 48 hours. Fux's request, stemming from a legal action by the Progressistas (PP) party, seeks to review the legality of various proceedings, including those related to the investigation of a coup attempt and digital militias.

Fachin denied the request for immediate full access, stating that the STF Presidency is currently conducting an individual analysis of approximately 104 to 108 pending procedures linked to the inquiry. He noted that some materials required digitization and organization before they could be reviewed.

Fachin clarified that once the analysis of these pending items is complete and necessary diligences are carried out with the Federal Police and the Prosecutor General's Office (PGR), the inquiry will be moved toward definitive archiving. He emphasized that the eventual archiving will not automatically nullify previous decisions made by former rapporteur Alexandre de Moraes, and that full public access to the files will be granted only after the procedural steps are finalized.
