Flordelis: STJ upholds 50-year sentence for husband's murder
The Superior Tribunal de Justiça (STJ) has unanimously upheld the 50-year prison sentence for former federal deputy Flordelis dos Santos de Souza. The conviction pertains to the 2019 murder of her husband, pastor Anderson do Carmo de Souza, in Niterói.
Flordelis was found guilty of several crimes, including consummated triple-qualified homicide, attempted double-qualified homicide, armed criminal association, and the use of false documents. Prosecutors stated the murder was planned to gain control over family finances and address conflicts managed by the pastor.
The defense's appeal to the STJ sought to annul the conviction, citing procedural errors such as the lack of final arguments during the pronouncement phase and insufficient justification for the crime's aggravating factors. However, the court's rapporteur, Judge Nilsoni de Freitas, rejected these claims, stating that the defense failed to demonstrate any concrete prejudice resulting from these alleged irregularities.
Additionally, the STJ confirmed a decision by the Tribunal de Justiça do Rio de Janeiro (TJRJ) to annul the acquittal of Flordelis's biological granddaughter, Rayane dos Santos Oliveira, and her two adopted children, Marzy Teixeira da Silva and André Luiz de Oliveira. These three individuals are now scheduled to face a new jury trial.
