Brazil Supreme Court excludes ISS from PIS/Cofins calculation base
The Supreme Federal Court (STF) ruled by a 6 to 5 majority that the Service Tax (ISS) does not constitute part of the calculation base for the PIS and Cofins federal contributions. The decision, which concluded a legal dispute dating back to 2008, establishes that ISS is a transitory financial entry that merely passes through a company's accounts to be transferred to municipal or District Federal coffers, rather than forming part of the company's actual revenue or patrimony.
The ruling has general repercussion, meaning the legal thesis must be applied to all similar ongoing cases across Brazil. This decision favors service providers—such as medical clinics, schools, and technical assistance firms—but represents a significant fiscal challenge for the federal government. Estimates from the 2026 Budget Guidelines Law (LDO) suggest a potential impact of up to R$ 35.4 billion on federal accounts.
Minister Luiz Fux provided the tie-breaking vote, following the reasoning of retired Minister Celso de Mello. While Fux proposed that the decision's effects should only apply prospectively to mitigate fiscal damage, the Court has not yet finalized the modulation of the decision's effects, pending potential motions for clarification.
