TSE orders removal of Flávio Bolsonaro video linking Lula to criminal groups

The Superior Electoral Court (TSE) has ordered the removal of a video published by Senator Flávio Bolsonaro that falsely associates President Luiz Inácio Lula da Silva with the criminal organizations PCC and Comando Vermelho. In a 5-2 vote, the court determined that the content exceeded the limits of political discourse and constituted premature negative electoral propaganda.

The decision, which also applies to the social media platform X, requires the content to be made unavailable and prohibits the senator from republishing substantially identical material without a minimum factual basis. The legal action was initiated by the Federação Brasil da Esperança, a coalition comprising the PT, PCdoB, and PV.

The ruling overturns a previous decision by TSE President Nunes Marques, who had initially allowed the video to remain online. The court also declined a separate request by Minister André Mendonça regarding the submission of documents from the Federação Brasil da Esperança, instead determining that the case required redistribution.
