Supreme Federal Court resumes Ficha Limpa Law trial
The Brazilian Supreme Federal Court (STF) has resumed the trial concerning changes to the Ficha Limpa Law, specifically regarding the calculation of ineligibility periods for politicians. The court is reviewing Complementary Law 219/2025, which modifies how the eight-year ineligibility period is counted. Under the new law, the period begins from the date of conviction rather than after the completion of a sentence, and the maximum ineligibility period for administrative improbity is unified at 12 years.
During the proceedings, Minister Gilmar Mendes voted in favor of the validity of these congressional changes for the current election cycle. He proposed an 18-month transition period, during which the original text would apply, allowing Congress time to review the matter. The current vote count stands at 2 to 1 against the changes, with Ministers Cármen Lúcia and Luiz Fux voting against them.
Following Mendes' vote, Minister Flávio Dino requested that the trial be moved from a virtual session to a physical plenary session. The decision to move the trial to a face-to-face format means the analysis will be restarted in person, though a specific date for this session has not yet been scheduled.
