CLARITY Act: U.S. Senate vote on crypto regulation set for Sept. 15
The U.S. Senate is scheduled to hold a critical cloture vote on the CLARITY Act (Digital Asset Market Clarity Act) on September 15, 2026. The legislation, which has already passed the House and the Senate Banking Committee, aims to establish a regulatory framework by delineating oversight between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC).
Coinbase CEO Brian Armstrong has advocated for the bill, stating it would protect consumers from harm and guard the industry against government overreach. However, the bill faces political hurdles, including opposition from some Democrats regarding ethics provisions and certain Republicans regarding stablecoin rules.
If the CLARITY Act fails to pass, federal agencies are prepared to implement alternative regulations. CFTC Chairman Mike Selig indicated that the agency would use its existing authorities to create a regulatory framework for crypto asset markets. This potential framework could include a new designation for crypto asset markets, which might allow exchanges to offer leveraged or margin-based trading under CFTC oversight. Meanwhile, the SEC has already proposed its first-ever crypto securities framework, titled ‘Regulation Crypto Assets’.
