Brčko attack on minors leads to jurisdictional dispute

On August 18, a group of 10 to 15 masked men attacked two minors in the Ivica neighborhood of Brčko, demanding they remove t-shirts featuring lily symbols. Following the incident, the Brčko District Police arrested four individuals on suspicion of inciting national, racial, and religious hatred, a criminal offense under Article 145a of the Criminal Code of Bosnia and Herzegovina.

Legal proceedings have faced delays due to jurisdictional disputes between different prosecutorial bodies. While police stated that the Prosecutor's Office of Bosnia and Herzegovina had been notified, that office reported that no such filing had been recorded and directed inquiries back to the Brčko District Prosecutor's Office. The Brčko District Prosecutor's Office clarified that it lacks legal jurisdiction over the matter because the suspected crime falls under the Criminal Code of Bosnia and Herzegovina rather than the local Brčko District code, necessitating the transfer of the case to the state-level prosecutor.
