Bryan Kohberger's defense seeks to remove judge from case

Bryan Kohberger’s defense team is seeking to disqualify Judge Steven Hippler from his post-conviction proceedings. Court-appointed attorney Gregory Rauch argues that the judge’s previous comments during sentencing demonstrate bias and undermine the impartiality required for the case.

During the sentencing of Kohberger, who is serving four life sentences for the 2022 murders of four University of Idaho students, Judge Hippler made several disparaging remarks. The judge referred to Kohberger as the “worst of the worst” and questioned the defendant’s capacity for truthfulness, suggesting that any statement Kohberger might make could be “self-serving and aggrandizing untruthful bits.”

The defense is also challenging the circumstances surrounding Kohberger’s guilty plea. Rauch argues that Kohberger’s former legal team may not have had sufficient time to properly advise him on his capacity to understand the proceedings or make informed decisions regarding his defense. The motion seeks to examine whether Kohberger rationally understood his circumstances at the time of the plea agreement, which was intended to spare him the death penalty.
