Buenos Aires deputies pass new housing protection law for notaries

The Chamber of Deputies of the Province of Buenos Aires has passed a law modifying regulations for notary activities. The reform establishes a new obligation for notaries involved in real estate transactions related to residential housing.

Under the new law, professionals must inform property owners or authorized individuals about the possibility of incorporating the property into the housing protection regime established by the National Civil and Commercial Code. Notaries are required to explain the existence of this regime and the available alternatives for accessing it, including the option to complete the process during the same notarial act.

If a property owner decides not to include their home in the protection regime, the notary must explicitly record that the information was provided and that the proposal was rejected. The initiative, presented by Senator Marcelo Feliú, aims to ensure that individuals are aware of mechanisms designed to protect housing against economic difficulties and safeguard family assets.
