Bundesgerichtshof rules on broadcasting fee enforcement

The German Federal Court of Justice (BGH) has ruled that a specific compulsory enforcement action regarding unpaid broadcasting fees (Rundfunkbeitrag) was inadmissible. The decision, issued by the VII. Civil Senate, centered on a failure to meet formal requirements for electronically transmitted enforcement requests.

The case originated in Bavaria, where a public broadcasting institution attempted to collect arrears through a bailiff. The legal challenge arose because the electronic document sent from a special authority mailbox did not properly identify the individual responsible for the content of the request. Specifically, the name provided at the end of the document did not correspond to the person actually liable for the enforcement request's content.

While the BGH overturned previous lower court decisions and declared this specific enforcement procedure inadmissible, the ruling does not automatically cancel the underlying obligation to pay the broadcasting fees. The court addressed the procedural error regarding electronic documentation requirements under § 130a ZPO rather than the debt itself.
