Bundesgerichtshof to rule on Wuppertal street art dispute

The German Federal Court of Justice (BGH) is set to rule on a legal dispute involving a street art project in Wuppertal. The case centers on a high-rise building where a majority of apartment owners approved a contract to feature a large-scale mural on the north facade as part of a city-wide art initiative.

A single property owner is challenging the decision, seeking to have the majority vote declared invalid. The plaintiff argues that the artwork would fundamentally alter the residential complex, potentially prevent the installation of air conditioning units on the facade, and lead to increased visitor traffic. The court's decision will address the extent of a majority's power within large homeowner associations.

Separately, the art association ‘WupperOne929 Urban Art’ has issued a statement distancing itself from the ‘Mural App Wuppertal’ initiative. The association clarified that there has been no cooperation or partnership between their organization and the app initiative.
