Bundesnetzagentur oversees EU AI Act compliance in Germany
Since August 2, 2026, the Bundesnetzagentur has acted as the central supervisory authority for the EU AI Act in Germany. Companies face significant financial risks for failing to meet transparency obligations.
The regulation distinguishes between two critical control principles for high-risk AI applications: 'Human in the Loop' and 'Human in Command'. 'Human in the Loop' operates at a functional level, where staff continuously validate AI-generated data and outputs. In contrast, 'Human in Command' provides strategic authority, granting humans the power to veto automated actions and decide on the overall deployment or termination of AI systems.
While comprehensive detailed requirements for high-risk AI systems will be phased in through 2027, general transparency obligations under Article 50 have been in effect since August 2026.
